As of the May 25th, 2018, every company that deals with European customers has to comply with the new European General Data Protection Regulation or GDPR in short.
In simple terms, it:
Applies to personal data — any data that relates to or can be used to identify a person in any way
Controls what can be done with personal information
Requires that consent is given or there is a good reason to process or store personal information.
Gives a person a right to know what information is held about them.
Allows a person to request information about them is erased and that they are ‘forgotten’ — unless there is a reason not to do this — e.g. a loan account.
Makes sure that personal information is properly protected. New systems must have protection designed into them (Privacy by Design). Access to data is strictly controlled and only given when required (Privacy by Default).

Data is securely deleted after it is no longer needed.

What information do you hold on me?
Whenever you use one of the forms on this website to contact us or send us other information we keep a record of these form transmissions in our secure online database and in our email inbox. What happens in case of a security breach?
In the unlikely event your data is lost, stolen or accessed without authority you and the Data Protection Commissioner will be notified within 72 hours.
You will remain responsible for yourself and your child throughout each visit.
You or the nominated guardian must conduct yourselves to promote the safety and comfort of all in attendance, and we can request that either you or the guardian vacate the premises immediately if we feel it reasonable in the circumstances. In this event, Kilkee Waterworld will not provide a refund.
It would be best to take all rubbish to the provided bin at the end of each session.
Any abusive or offensive behaviour towards any staff member (or venue staff) will not be tolerated, and you will be asked to leave the lesson.
All swimmers must wear a swim cap when attending sessions.
Parents must remain in the building during swimming session times.
If you have complaints, then please inform us in writing at info@kilkeewaterworld.ie
Neither You nor a guardian should enter the swimming pool until permitted by the instructor.
Your baby or toddler will not be allowed to participate in the session unless you or the nominated guardian can enter the water with your baby to assume responsibility.
It would be best to take all rubbish and nappies to the provided bin at the end of each session.
Photography is strictly prohibited.
Booking and Payment Conditions:
A Contract comprising these Terms and Conditions will come into effect once you submit a booking form to Kilkee Waterworld CLG
All bookings are accepted on a first-come, first-served basis and we cannot guarantee your choice of day and time. It is, therefore, in your interest to submit full payment along with the booking form before the deadline expires.
If on receipt of your booking form and payment, we cannot offer you your first or second choice, then we will telephone, email or text you to arrange an alternative.
Any correspondence or other contact will be directed to you and if any of your personal details change at any stage during the course you must notify us immediately.
Occasionally, it may become necessary to cancel/rearrange a session due to unforeseen circumstances. If this happens, Kilkee Waterworld will organise an alternative session, and we will do our best to inform all participants about this occurrence as soon as possible. The alternate session may occur on different days and times, and with other instructors. However, we cannot offer credit or a refund if you cannot attend the rearranged sessions.
The above applies to all class types and sessions at Kilkee Waterworld.
Please note: We also operate a 48 hr cancellation period with regards Public swim and one to one private session cancellation.
Any Private sessions booked, and cancelled by the customer within 48 hrs of the agreed lesson, will not be refunded or credited.
Private sessions booked and cancelled outside of 48 hrs, we will re-arrange once to suit and at no extra cost.
All other rescheduling of Privates will have a €10 admin fee charge applied.
All rescheduling of Private lessons must be done by email to info@kilkeewaterworld.ie only.
NOTE: If you (the customer) have to cancel any group session(s) for any reason, please be aware that we do not provide credit or a refund.
In the event of a course/class not commencing (e.g. Insufficient student numbers on enrolment, pool closures, any circumstance that stops a course from commencing when scheduled) Kilkee Waterworld will offer an alternative course/start date. If the alternatives offered do not suit, Kilkee Waterworld will give credit towards the next term. Refunds will not be offered.
At Kilkee waterworld, we strive to create the best learning environment for all our visitors, students and participants. Our group classes are designed to foster social interaction and provide a dynamic learning experience.
As such, our policy states that a group consists of six or more children. Running a course as a group, with only one or two children, at group rates, is not viable for various reasons. This includes maintaining the quality of instruction, managing costs, and ensuring the best experience for your child.
If there is less than six children in a course after Week 2 of a term, we will provide you with two options:
Move to a Different Day and Time: We will offer you the opportunity to switch to another class with sufficient children. This will allow your child to continue in a group setting and benefit from the social and interactive aspects of the lessons.
Pay for Private Lessons: Alternatively, you can continue with current time but it will class as private group lessons, providing personalised attention and focusing on your child's specific needs and goals. Private lessons offer a tailored approach to accelerate progress and skill development.
Please note that credit will not be offered once the options kick in, as the costs and arrangements for instructors and pool availability have already been made based on the scheduled class type (group or private).
NOTE: If you (the customer) have to cancel any term or group session(s) for any reason, at any stage of the process, please be aware that we do not provide credit or a refund.
Additionally, once the term begins, if you (the customer) have to cancel any sessions, please be aware that we do not offer credit or refunds.
We understand that unforeseen circumstances can occur, leading to missed sessions. However, to maintain the quality and structure of our classes, which are scheduled based on bookings, we adhere to the following policy regarding missed sessions:
No Refunds or Credits:
We do not offer refunds or credits for sessions missed by customers, regardless of the reason for absence.
Our classes are planned and staffed based on confirmed bookings, and the absence of a participant does not diminish the costs associated with holding the class.
Exception for Certified Sickness:
The only exception to our no-refund and no-credit policy is in the case of a certified sickness.
If a customer is unable to attend a session due to illness and can provide a doctor's note to verify their condition, we will issue a make-up voucher to the customer.
This token can be used to book another session at a later date, subject to availability.
Make-Up Tokens:
Make-up vouchers issued for certified sickness must be used within a specified time frame, typically within the current term, to ensure availability and maintain class balance.
The specifics of this time frame will be communicated at the time the token is issued.
Notification of Absence:
While we do not offer refunds or credits for missed sessions, we appreciate being notified of a customer's inability to attend as soon as possible.
This courtesy does not affect the application of our missed session policy but allows us to adjust our class preparations accordingly.
Responsibility to Attend:
The customer is responsible for remembering their booking dates and times and attending as scheduled.
We recommend adding your class schedule to your calendar and setting reminders to help avoid missed bookings.
There are several reasons why Kilkee Waterworld has a policy of not offering refunds and charging an administration fee of €50 if a refund is granted under exceptional circumstances.
Firstly, the nature of our business is such that we have a limited number of spaces available in each timeslot and class and when a customer cancels their booking, it can be difficult to fill that space again. This can result in lost income for our business.
Secondly, we invest significant time and resources in planning and preparing for each term of classes, including hiring and training our instructors, purchasing equipment and pool time. When a customer cancels, it can disrupt this planning process and result in wasted resources.
Finally, the administration fee of €50 is intended to cover the administrative costs associated with processing a refund, including staff time, bank fees, and other related expenses.
It is important to note that we understand that unforeseen circumstances can arise, and we will always do our best to work with our customers to find a suitable solution, such as rescheduling classes or offering credit towards future classes. We value our customers and strive to provide the best possible service, while also balancing the needs of our business.
Although we retain the same instructors for the lessons, occasionally, we might have no choice but to change the instructor in the event of illness or other unforeseen circumstances.
Every effort is made to keep lesson numbers low, but any target lesson numbers given are just that, and we reserve the right to alter lesson sizes if necessary.
Children should be supervised at all times before, during and after the session by their parent or guardian.
Babies and toddlers must wear special swim nappies and swimsuits or swimming togs over the swim nappy during sessions. Only children who are toilet trained do not have to use swim nappies.
For those in lessons or swim camps you must inform your swimming instructor if there is any medical condition of the participant (either parent/guardian or baby/toddler/child) that may be relevant.
If you or the guardian know of any illness medical condition or allergy caused to the baby, toddler or child, you must notify us and the instructor prior to any session and give full details so that we can take appropriate action or precautions if necessary.
If we feel the baby, toddler or child cannot do their session due to illness, allergy or other appropriate reasons, and we reserve the right to prevent the participant from attending a session or the course. In such circumstances, we are unable to offer any refund.
Only one parent/guardian per swimmer are allowed into all venues we teach in. No siblings / other family members or friends are permitted into venues unless under exceptional circumstances.
All swimmers are expected to shower before entering pools and to please bring flip flops that have not been worn outside and must be worn at all times in the pool area.
All personal belongings should be kept secure. Kilkee Waterworld does not take responsibility for items that get damaged, lost or stolen.
All information you provide, including you and your child’s personal data, will be secured in the Kilkee Waterworld database and cannot be accessed by unauthorised persons. Kilkee Waterworld does not retain credit/debit card details on site. However, as the internet is not 100% secure, you provide all information at your own risk.
By entering our website, sending us an email or completing our forms, you provide specific personal details to offer our service to you. We will use your personal information for correspondence, including emails, posts, text messages and phone calls (if necessary). Please inform us if you do not wish to receive any mail from Kilkee Waterworld.
On our website, you may come across links that redirect you to Third-Party Websites. Kilkee Waterworld does not have any rights to the Third third-party websites and does not take responsibility for their privacy policy strategy.
Gift certificates are not redeemable for cash.
This gift certificate is non-transferable, and resale is prohibited.
If a gift certificate is lost, stolen, damaged, destroyed or used without permission, Kilkee Waterworld cannot guarantee a replacement in these circumstances.
The gift certificate cannot be combined with other vouchers and is not valid with any other promotions or offers.
Agreement and Enrolment:
By entering into the payment plan and holding places for the new term, you acknowledge and agree that you are committed to paying the full-term fees according to the agreed payment schedule.
Non-Participation and Refunds:
If you decide not to partake in the lessons after entering into the payment plan, please note that no refunds will be provided.
By reserving a place for your child, we allocate resources and plan accordingly, making it difficult to fill the vacancy at a later stage.
Exceptional Circumstances:
A refund may be considered in exceptional circumstances where a refund is accepted, such as severe illness.
However, please be aware that a €50 administrative charge per child will be deducted from the refund amount to cover the associated administrative costs.
Non-Payment of Fees:
If you choose to enter any payment plans, the term fees must be paid by the agreed-upon dates.
Failure to do so may result in your child being removed from their classes, as we rely on timely payments to sustain the smooth operation of our programs.
Please note that no refunds or credit will be issued in such cases.
Changes to Payment Plans:
Should you wish to make any changes to your payment plan, such as switching from one plan to another, don't hesitate to contact our administration team at info@kilkeewaterworld.ie in advance to discuss the available options. We will do our best to accommodate your request, but please note that changes may be subject to certain limitations and additional fees.
By enrolling you or your child and entering into the payment plan, you acknowledge that you have read, understood, and agreed to abide by the above mentioned terms and conditions.
We appreciate your cooperation and understanding in ensuring the smooth running of our operations.
Kilkee Waterworld has the absolute right to refuse admission to any of our swimming sessions lessons or classes.
A safe and secure working environment is necessary for our staff to work in and is of paramount importance to us and therefore staff are instructed not to accept or tolerate any level of violent,
abusive or threatening behaviour that is directed towards them, via email, text, phone calls, or face to face.
Please be aware that from time to time, Kilkee Waterworld Terms and Conditions may change or be updated, and we advise you to keep yourself familiar with these.
